1. Acceptance of Terms

By creating an account and using Domain Pilot, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our service.

2. Description of Service

Domain Pilot is a domain monitoring and portfolio management service that provides automated checking of domain availability, expiry dates, WHOIS information, SSL certificates, and related services. The service provides notifications and alerts based on detected changes.

2.1 Service Features Include:

• Automated domain status checking and monitoring
• Email notifications and webhook integrations for alerts
• WHOIS data retrieval and tracking
• Domain grouping, organisation, and tagging
• Historical domain status tracking
• Contact management and reporting tools
• API access (on Business plans)

3. User Responsibility and Liability

YOU ARE SOLELY RESPONSIBLE FOR YOUR DOMAINS AND ALL DECISIONS MADE REGARDING THEM. Domain Pilot is a monitoring and alert tool only. The service does not manage, control, or have the ability to take direct action on your domains.

3.1 Your Responsibilities:

• Domain Renewal: You are solely responsible for renewing your domains before expiration. Domain Pilot provides alerts only; failure to act on notifications is your responsibility.
• Domain Registration: You must register and maintain ownership of your domains through authorised registrars. Domain Pilot does not register or purchase domains for you.
• Contact Information: You are responsible for ensuring your contact information is accurate and current with your registrars.
• Security: You are responsible for protecting your account credentials and authorising any domain transfers or modifications.
• Legal Compliance: You are responsible for ensuring your use of domains complies with all applicable laws and regulations.
• Domain Disputes: You are responsible for resolving any disputes, claims, or legal matters related to your domains.

3.2 What Domain Pilot Does NOT Do:

• We do not renew or manage your domains
• We do not guarantee alert delivery or timeliness
• We do not transfer domains or take administrative action
• We do not control domain registrars or WHOIS records
• We do not guarantee WHOIS data accuracy
• We are not responsible for registrar changes or policies
• We do not provide legal or financial advice about domains

4. User Accounts

4.1 Account Creation

To use Domain Pilot, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

4.2 Account Responsibility

You are solely and entirely responsible for all activities, actions, and consequences that occur under your account. You must immediately notify us of any unauthorised access or suspicious activity.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, abuse of the service, non-payment, or for any other reason we deem appropriate.

5. Subscription Plans and Billing

5.1 Subscription Tiers

• Free Plan: Limited features, up to 5 domains, daily monitoring
• Pro Plan: Unlimited domains, hourly monitoring, advanced features
• Business Plan: All features, 30-minute checks, API access, webhooks

5.2 Billing Terms

Paid subscriptions are billed in advance monthly or annually. All fees are in British Pounds (GBP) unless otherwise specified. Payment is non-refundable except where required by law.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled beforehand. You can cancel anytime from your account settings.

5.4 Plan Changes

You may upgrade, downgrade, or cancel your plan at any time. Changes take effect at the end of your current billing cycle. Upgrades take effect immediately with prorated charges.

6. Limitation of Liability and Indemnification

YOU ACKNOWLEDGE AND ACCEPT THAT DOMAIN PILOT HAS LIMITED LIABILITY FOR YOUR USE OF THE SERVICE.

6.1 We Are Not Liable For:

• Loss of domain ownership or control
• Missed opportunities to renew or register domains
• Missed opportunities to register expiring or dropped domains
• Delayed, missed, or failed alert notifications
• Inaccuracies in WHOIS data or domain status information
• Registrar system failures or changes
• Your failure to act on notifications or alerts
• Loss of revenue or business opportunity from domain issues
• Indirect, incidental, consequential, or punitive damages
• Service interruptions or downtime (scheduled or unscheduled)
• Third-party registrar or WHOIS service failures
• Any outcomes related to your domain management decisions

6.2 Liability Cap

Our total liability to you shall not exceed the amount you paid us in the preceding 12 months, or £100, whichever is greater. This applies to all claims regardless of cause.

6.3 User Indemnification

You agree to indemnify and hold harmless Domain Pilot, its owners, employees, and agents from any claims, damages, liabilities, or expenses arising from: (a) your use of the service, (b) your violation of these Terms, (c) your domains or their use, or (d) your violation of any third-party rights.

7. Service Availability and Accuracy

7.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted service, error-free operation, or specific results.

7.2 No Guarantees

We do not guarantee:

• Alert notifications will be delivered or delivered on time
• WHOIS data accuracy or completeness
• Domain availability information is current
• Uninterrupted service access
• No service errors or downtime
• Fitness for any particular purpose

7.3 Maintenance and Downtime

We may perform scheduled and unscheduled maintenance that affects service availability. We will attempt to provide advance notice of scheduled maintenance but do not guarantee this.

8. Acceptable Use

8.1 Prohibited Activities

You agree not to:

• Use the service for any illegal or unauthorised purpose
• Monitor domains you do not legitimately own or have interest in
• Monitor domains for unauthorised resale or speculation
• Attempt unauthorised access to our systems
• Interfere with or disrupt the service or infrastructure
• Use automated systems to abuse or overload our servers
• Resell, redistribute, or reverse-engineer the service
• Use the service to harass, stalk, defame, or harm others
• Violate any applicable laws or regulations
• Violate third-party intellectual property or privacy rights

8.2 Rate Limiting

We enforce rate limiting to ensure fair usage and service stability. Excessive API requests, automated abuse, or unusual patterns may result in temporary suspension or permanent account termination.

9. Third-Party Services

Domain Pilot relies on third-party WHOIS registries, domain registrars, and related services. We are not responsible for the accuracy, availability, completeness, or reliability of data from these external services. We do not control these third parties and cannot guarantee their performance.

10. Intellectual Property

All content, features, design, and functionality of Domain Pilot are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

11. Privacy and Data

Your use of Domain Pilot is governed by our Privacy Policy. By using the service, you consent to our collection, use, and processing of your data as described in the Privacy Policy. See our Privacy Policy for details.

12. Modification of Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the service after changes constitute acceptance of modified Terms.

13. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We provide refunds only where required by law (first 30 days of paid plans under certain circumstances).

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
